Terms of Use
These terms apply when you use the Sirvanos Go app or sirvanosgo.com. Sirvanos Go is provided by NexPhaz ("we", "us"). By using Sirvanos Go you agree to these terms and to our Privacy Policy. If you do not agree, please do not use it.
1. The restaurant sells the food; we provide the platform
Each restaurant on Sirvanos Go is an independent business. The restaurant is the seller of the food. It sets its menu, prices, taxes, fees, hours, delivery area and minimum order; it prepares your food; and it delivers it with its own drivers. NexPhaz provides the app and the technology that connects you with the restaurant. We do not prepare, handle or deliver food, and drivers are not employed by NexPhaz.
If you have a food allergy or dietary need, ask the restaurant directly before you order. Descriptions and photos are provided by the restaurant.
2. Orders, prices and refunds
- When you place an order, you are offering to buy from the restaurant. The restaurant may accept or decline it, for example if it is too busy or an item has run out.
- The total shown at checkout, including tax, fees and tip, is the amount for that order. Arrival and ready times are estimates.
- Orders, prices, changes, cancellations and refunds are handled by the restaurant. For a problem with an order, contact the restaurant; its phone number is on your order screen in the app. If you cannot reach the restaurant, write to us and we will try to help, but refund decisions belong to the restaurant.
- Card payments are processed by our payment processor. If you choose cash (where the restaurant accepts it), you pay the driver, or the restaurant at pickup.
- Please give a correct name, phone number and address so the restaurant can reach you and deliver your order.
3. Accounts for restaurant staff and drivers
Restaurant staff and drivers join with an invite from their restaurant. Keep your password private, and tell your manager or us if you think someone else has used your account. Your restaurant decides who has access and can remove it. Your working relationship is with the restaurant, not with NexPhaz. Drivers must follow traffic laws and should only use the app when it is safe to do so.
4. Acceptable use
Please do not:
- place fake orders, or orders you do not intend to accept or pay for;
- use someone else's payment card or account without permission;
- harass, threaten or abuse restaurant staff, drivers or guests;
- break the law, or use Sirvanos Go to deliver anything unlawful;
- try to get into data or accounts that are not yours, interfere with the service's security, or overload it;
- copy, scrape, resell, or reverse engineer the app, except as the law allows.
We may suspend or end access for anyone who breaks these rules or puts other people at risk.
5. The app
We give you a personal, non-transferable licence to use the app on your own devices; the app is licensed, not sold. If you downloaded it from Apple's App Store, Apple's standard Licensed Application End User License Agreement also applies, and Apple is not responsible for the app or its support. We may update, change or stop parts of Sirvanos Go, and it may sometimes be unavailable.
6. Our responsibility, in plain language
- We work hard to keep Sirvanos Go running and accurate, but we provide it "as is" and cannot promise it will always be available or free of errors.
- The restaurant is responsible for the food, its quality and safety, allergen information, its prices and its delivery. We are not responsible for those.
- As far as the law allows, NexPhaz is not liable for indirect or consequential losses (such as lost profits), and our total liability to you for any claim about Sirvanos Go is limited to the greater of the amount you paid NexPhaz in the 12 months before the claim or US$100.
- Nothing in these terms takes away rights you have under consumer protection laws that cannot be waived.
7. Changes
We may update these terms. We will post the new version here with a new effective date, and tell you in the app or on this website if a change is significant. If you keep using Sirvanos Go after a change takes effect, the new terms apply.
